TERMS AND CONDITIONS OF SALE
The offer and sale of products through the site Filicori Zecchini of G.I.Fi.Ze. Industrial Group Filicori Zecchini s.p.a. is governed by the General Terms and Conditions of Sale, explained below.
The General Conditions of Sale are formulated in accordance with the regulations on contracts concluded outside business premises and in particular with the provisions of Legislative Decree No. 206 of September 6, 2005 (Consumer Code).
PARTS OF THE CONTRACT
The following are to be considered parties to the contract: G.I.Fi.Ze. Industrial Group Filicori Zecchini s.p.a., headquartered in 40060, Castel San Pietro Terme, locality Osteria Grande, Bologna, via Lombardia n. 55, REA 153878 - Reg. Imp. BO and C.F. 00805700374 - P.I. 00523821205 (hereinafter referred to as "Gifize"); and the person (natural person, company or other legal entity) who, having registered within the site http://www.filicorizecchini.com, has concluded an order that has been accepted by Gifize (hereinafter referred to as "Customer").
APPLICATION AND MODIFICATION OF THE GENERAL CONDITIONS OF SALE
By placing the order in the manner provided, the Customer declares that he/she has read all the information provided during the purchase process and fully accepts the General Conditions of Sale. Gifize reserves the right to vary the General Conditions of Sale by giving notice on this page of the site.
The applicable General Terms and Conditions of Sale are those in effect at the time the order is placed. Any changes will be effective after publication on the site.
CHARACTERISTICS AND PRICES OF PRODUCTS OR SERVICES
Images of products may not be perfectly representative of their characteristics but differ in color, size, accessory products represented.
All purchase support information is intended as mere general information material, not referring to the actual characteristics of an individual product.
Products are offered at the price shown on the site on the date the order is placed.
Prices are inclusive of VAT, which will be detailed in the invoice for the purchase of the product.
Prices do not include transport and delivery costs, which are however indicated in the final section before sending the order and specified in the order receipt confirmation sent by e-mail to the Customer.
PLACING OF ORDERS
Orders can be placed to and from the following territories: the Italian Republic, Republic of San Marino, Vatican City.
Orders are subject to minimum or maximum quantity limitations and products are offered within the limits of stock availability.
Orders will not be accepted from individuals who have not reached the age of majority. The steps for placing the order and concluding the purchase contract are clearly highlighted in the sequence of pages on the site through explanatory text and graphics.
In particular, it is advisable to take a look at the withdrawal notice, which is printable at any time.
It is possible to correct any errors in data entry before sending the order.
CONFIRMATION OF RECEIPT OF THE ORDER AND ACCEPTANCE OF THE SAME
Upon receipt of an order, Gifize will automatically send a confirmation of receipt by e-mail, in which all the details of the order will be summarized.
Upon receipt of an order, Gifize will verify the actual availability of the ordered product and only upon the positive outcome of this verification will it communicate its acceptance of the order and the successful shipment of the product.
In the event that Gifize is unable to process an order received will promptly notify the Customer.
Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance of an order is excluded.
ACCEPTED METHODS OF PAYMENT
Gifize accepts payment only through the systems indicated in the footer of the site.
Product shipments and deliveries can only be made within the territories of the following countries: Italy, Austria, Belgium, Bulgaria, Czech Republic, Croatia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, United Kingdom, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland.
Gifize will only ship purchased products to the destination address specified in the order.
We do not accept shipments to P.O. Boxes.
Gifize will ship the products ordered by the Customer, by courier, to the address indicated by the same, approximately within 3 (three) working days after acceptance of the order.
Delivery is generally within 5 working days.
The times reported for the receipt of goods are indicative.
Delivery charges are billed based on the rates shown on the Site on the date the order was transmitted.
The consignee of the goods is responsible for the payment of taxes and customs charges provided by the regulations in force in the territory of destination of the products.
The courier is responsible for delivery.
Gifize undertakes to collect any reports of non-delivery or delayed delivery of the products through Customer Service and, where appropriate, to assist the Customer to protect its rights as per law.
ACCEPTANCE OF THE PRODUCT BY THE CUSTOMER
Any damage to the packaging and/or the product or the mismatch of the number of packages or indications must be immediately contested by making specific indication on the delivery document.
By signing the courier document, the Customer certifies the external integrity of the product and the conformity of the delivery.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 10 working days after delivery by sending an email to the address
An invoice will be issued for each order of the Private Customer who has entered his tax code, and for each order of the Professional Customer or company with VAT number.
For the issuance of the invoice, the information provided by the Customer at the time of the order shall be authentic.
No changes in the invoice will be possible after the invoice has been issued. When ordering, it is necessary to indicate whether the shipping address is different from the billing address.
RIGHT OF WITHDRAWAL AND RULES FOR THE RETURN OF PRODUCTS
In execution of the provisions of Legislative Decree 185/99 implementing Directive 97/7/EC on the protection of consumers in respect of distance contracts, the Customer may return the purchased product and obtain a refund of the purchase sum actually paid.
The right of withdrawal may be exercised within 10 working days of receipt of the product in the following ways: 1) The customer shall send a registered letter with return receipt to Gifize; notice may be sent, within the same period, by telegram or e-mail. to email@example.com. 2) Gifize contacts the Customer by communicating the Return Authorization Code. 3) The Customer reports the Authorization Code on the return form received together with the delivery documents. 4) The Customer is then contacted by the courier company to take charge of the return.
The return of the product must take place within 10 working days from the date of receipt of the Authorization Code.
The refund of the price paid for the purchase of the product does not include shipping costs, which are the full responsibility of the Customer who intends to withdraw from the purchase.
In the event that the Customer sends back products that are damaged, do not have a Return Authorization Code, are not returned within the above deadline, are opened and/or partially used, are not packaged regularly or completely, or in which certain parts, such as components, elements, accessories, packaging materials, boxes, documentation and/or other items are missing or have been damaged, the right of withdrawal shall be forfeited in full.
In the cases mentioned above, Gifize will return the purchased goods to the Customer by charging him/her the shipping costs.
With the above limitations, Gifize will refund the amount actually paid by the Customer within 30 days of the notice of withdrawal by means of a credit note to the bank account or credit card.
All products, other than food products, sold by Gifize are covered by the conventional manufacturer's warranty and 24-month warranty for defects of conformity in accordance with Legislative Decree 24/2002, as amended, and Articles 130 and 132 of Legislative Decree 206/2005.
To take advantage of warranty service, the customer must keep the invoice.
If the product purchased is found to have manufacturing defects and / or to have been damaged during transport, the customer may request the replacement of the same within the mandatory period of 10 days from receipt by telegram, or e-mail to firstname.lastname@example.org.
The Customer is also required to return the defective or damaged product in its original packaging intact in all its parts.
In case of replacement of the product, the shipping costs for the return shall be borne by Gifize.
The latter will then replace the product with an identical one or, in case of depletion of stock and upon agreement with the Customer, with one of equivalent value.
APPLICABLE LAW AND PLACE OF JURISDICTION
The sale of products and/or provision of services takes place in the territory of the Italian State and is subject to the laws in force in the Italian Republic.
For any dispute concerning the validity, interpretation and execution of this contract, the Court of Bologna shall have exclusive jurisdiction.
